1. Acceptance of Terms
By accessing or using memcard ("the Service"), you agree to be bound by these Terms & Conditions. If you do not agree, you may not use the Service.
2. Description of Service
memcard is a spaced-repetition flashcard application that helps users create, organise, and review flashcards using the Leitner box system. The Service includes AI-powered features for generating flashcards and courses from text or PDF content, as well as email and push notification reminders for scheduled reviews.
3. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you must have the consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.
4. User Accounts
You may create an account using email and password, or by authenticating via a supported third-party provider (GitHub or Google). You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.
5. Subscriptions and Payments
memcard offers a free trial period when you sign up. After the trial, a paid subscription is required to access certain features. Subscriptions are managed through our payment provider, Polar, and their terms apply to all payment processing.
We reserve the right to change subscription pricing with reasonable notice. Cancellation and refund terms are governed by Polar's policies.
6. User Content
You retain ownership of the flashcards and other content you create. By using the Service, you grant memcard a limited licence to store and process your content solely to provide the Service.
When you use AI generation features, the text or PDF content you provide is sent to a third-party AI service (Google Gemini) for processing. You retain ownership of your input and the generated output. See our Privacy Policy for details on how this data is handled.
7. AI-Generated Content
AI-generated flashcards and courses are provided for educational assistance only. memcard does not guarantee the accuracy, completeness, or suitability of any AI-generated content. You are responsible for reviewing and verifying AI-generated material before relying on it. memcard is not liable for errors or omissions in AI-generated output.
8. Acceptable Use
You agree not to misuse the Service, including but not limited to: reverse engineering the Service, using it to distribute malware, or attempting to gain unauthorised access to other users' data.
9. Data Protection
We process personal data in accordance with our Privacy Policy and applicable data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
10. Service Availability
memcard is provided "as is" without warranty of any kind. We do not guarantee uninterrupted or error-free operation. We reserve the right to modify or discontinue the Service at any time.
11. Limitation of Liability
To the maximum extent permitted by law, memcard shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
12. Changes to Terms
We may update these Terms from time to time. When we do, you will be asked to review and accept the updated terms before continuing to use the Service.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
